The Federal Tort Claims Act (FTCA) is a law passed by Congress to allow the United States to be sued for acts of its employees. It covers a number of things (property damage, personal injury, death, etc.), and excludes others (maritime acts, intentional wrongdoing, servicemen on active duty, discretionary acts by government employees).
Such claims include things such as medical malpractice by a Veterans Administration (VA) Hospital, as well as general personal injury claims against the government.
Federal Tort Claims may be properly filed either in the jurisdiction where the negligence occurred or where the claimant resides. Thus, our firm has litigated many claims in Federal Courts throughout Texas, even if the claims originated in other states, if the claimants become Texas residents.
