Fatal wreck involving improperly operated flatbed loaded with sheetrock

In this case, the fact that the flatbed truck driver has been cited roughly eight times for driving without a commercial driver's license makes this a pretty clear case of truck driver negligence, given the circumstances.

FM 2978 near the Hardin Store Road intersection in South County, Texas, was the site of a truck accident resulting in the loss of two lives yesterday. The 31-year-old flatbed truck driver - who authorities cited with operating without a valid commercial driver's license and unsafe driving - first clipped a pickup truck, crossed the center line and crashed into a second pickup truck.

The second pickup truck went into a ditch and exploded in flames, killing the driver and passenger. The driver who was originally clipped, as well as the flatbed truck driver and his passenger, were not hurt in the accident. The flatbed truck driver faces charges of criminal neglect in connection with the incident.

In Texas, as elsewhere, an incident such as this should give rise to a wrongful death action on behalf of those who were killed, brought against the negligent truck driver, who should not have been driving in the first place.
