Trucking Hit-And-Run Case Ends In $15 Million Award

More than two years after a hit-and-run crash claimed the lives of two women in 2010, a family received a $15 million jury verdict in their wrongful death claim against a trucking company.

Two days after Christmas in 2010, the two victims were walking together in a crosswalk. Although they had the right of way, a tractor truck pulling two trailers struck and killed tem. The driver fled the scene

Cases like this often look at the conduct of an individual driver but then attribute the liability to the driver's employer. This means that truck companies are potentially liable parties--they are often on the hook for their employees' mistakes. For victims, this is a big benefit. Truck drivers rarely have the resources or assets to completely compensate victims for the losses that their negligence or intentional misconduct can cause.

Trucking companies, on the other hand, have the resources to pay victims. In this case, the jury determined that the driver was to blame for the accident but that the crash happened "in this course and scope" of his work for an employer. This means that the trucking company will be responsible for paying the $15 million award.
