JOHN TYLER: Tyler and Peery has an edge in representing victims of drunk drivers. We have a lot of experience in representing injured people in this area of the law.
And we also have a lot of experience in Dram Shop litigation, which is the cause of action against the provider of alcohol.
DENNIS PEERY: We always have to prove whether or not someone was intoxicated on the premises in a Dram Shop case. Servers almost always will deny that they served anyone that was intoxicated. Servers will always point to the fact that they were trained by the Texas Alcoholic Beverage Commission, in other words they’re TABC certified. And if they can prove they’re TABC certified, then they get what’s called a Safe Harbor.
JOHN TYLER: We find that almost in all cases, the bartenders will not admit that they’ve oversold or over-served someone alcohol.
DENNIS PEERY: So we have to go beyond the initial inquiry as to whether or not they were certified to actually find out what their actions were and what the actions of the bar or restaurant were in encouraging their servers to continue to serve people who are already intoxicated.
